1. Parties and Scope
These Terms of Use (“Terms”) are binding on everyone who accesses and uses the Oxava platform (the “Service”). By using the Service, you are deemed to accept these Terms.
2. Account and Responsibility
You are responsible for safeguarding your account credentials. You are accountable for all activity that takes place under your account. Creating an account with false information is prohibited.
3. Content Generation and Copyright
You hold the commercial usage rights to the images you generate through the Service. However, by uploading reference images you represent that you own their copyright or are authorized to use them.
4. Prohibited Use
- Generating images that are unlawful, violent, obscene, or that contain hate speech is prohibited.
- Generating explicit or sexual content involving minors is strictly prohibited.
- Generating misleading images of real people (deepfakes) without their consent is prohibited.
- Automated attacks, abuse, or reverse-engineering attempts against the Service infrastructure are prohibited.
5. Generation Rights and Payment
The Service runs on a generation-rights usage model. A generation right included in the subscription is consumed per generation; for failed generations, the relevant generation right is automatically restored. Payments are collected via the iyzico infrastructure. Delivery, cancellation and refund terms are set out on the “Cancellation, Refund and Delivery Terms” and “Distance Sales Agreement” pages.
6. Service Changes and Termination
Oxava reserves the right to suspend or close an account when behavior in breach of these Terms is detected. The Service's features and pricing may change with prior notice.
7. Limitation of Liability
The Service is provided “as is.” You are responsible for the suitability of the content you generate. Oxava cannot be held liable for indirect damages.
